Terms of Service

1. Agreement to Terms
These Terms of Service (these "Terms") constitute a legally binding agreement between you and From The Scope ("From The Scope," "we," "us," or "our") governing your access to and use of fromthescope.com, the free scan tool, the website security reports, and the related services offered therein (collectively, the "Services"). By accessing the Services or purchasing a report, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
2. Authority to Request a Check
By submitting a domain for any check, you represent and warrant that you own or control that domain, or that you have obtained authorization from the owner to request a security check of it. The standard report examines only information that is publicly visible from outside the website. No login credentials, administrative access, or intrusive testing is used. Engagements that require authenticated testing or active security testing require a written scope of work and signed authorization before any work commences.
3. Services
The Services consist of external, non-intrusive website security checks, the reports produced from those checks (each, a "Report"), the Deep Audit service, and custom website builds. Each service is described on the relevant page of the website at the time of purchase. Descriptions of services are illustrative; the scope of a given engagement is as confirmed in writing at the time of order.
4. Report Generation and Delivery
Reports are generated using From The Scope's check methodology and plain-English fix library and are delivered by email as a dated PDF. Delivery timelines are estimates only and do not constitute a guarantee: most Reports are delivered within minutes of payment, and personal review is typically completed within 24 to 48 hours. From The Scope will not be liable for delays arising from circumstances beyond its reasonable control, including email deliverability and third-party service interruptions.
5. Personal Review
From The Scope personally reviews each Report and follows up with the purchaser where appropriate. Such review consists of verification of the Report against From The Scope's methodology. It does not constitute manual verification of every individual finding, and it does not constitute an assurance that the Report is exhaustive or free of all errors.
6. Fees, Payment, and Refunds
Fees for the Services are as stated at the time of purchase. Payment is processed by third-party payment processors; From The Scope does not collect or store payment card information. If From The Scope declines an engagement or is unable to deliver a Report, the purchaser will receive a full refund of the amount paid for that Report. Except as set forth in these Terms, completed Reports are non-refundable. Engagements priced at two hundred forty-nine dollars ($249.00) or more require written confirmation of scope prior to commencement.
7. Disclaimer of Warranties
THE SERVICES AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. A REPORT IS A POINT-IN-TIME ASSESSMENT OF INFORMATION VISIBLE FROM OUTSIDE A WEBSITE AT THE TIME OF THE CHECK. IT IS NOT A PENETRATION TEST, NOT A COMPLIANCE CERTIFICATION, AND NOT A GUARANTEE OF SECURITY. FROM THE SCOPE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY WEBSITE IS OR WILL REMAIN SECURE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FROM THE SCOPE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES. FROM THE SCOPE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC REPORT OR SERVICE GIVING RISE TO THE CLAIM. THE FOREGOING LIMITATIONS SHALL SURVIVE ANY TERMINATION OF YOUR USE OF THE SERVICES.
9. Acceptable Use
You agree not to: submit domains you do not own or control; use the Services in connection with any unlawful activity; resell, license, or otherwise exploit Reports as your own work product; or use any Report to misrepresent the security state of a website. From The Scope reserves the right to decline or refuse any engagement, and to terminate access to the Services, in its sole discretion.
10. Indemnification
You agree to indemnify, defend, and hold harmless From The Scope and its representatives from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of the rights of any third party.
11. Third-Party Services
Payment processing, form submission, and email delivery are provided by third-party services, including Gumroad, Formspree, and Cloudflare. Your use of those services is subject to their respective terms and privacy policies. From The Scope is not responsible for the availability, accuracy, or security practices of any third-party service.
12. Governing Law and Changes
These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions. From The Scope may update these Terms from time to time; the version posted at this page at any given time is the version in effect. Your continued use of the Services following any update constitutes acceptance of the revised Terms.
